New Compliance Date Set for the New FDA Label

If the final rule for the new Nutrition Facts label is issued between January 1, 2015, and December 31, 2016, food manufacturers will have until January 1, 2018 to comply with the new regulations. This compliance date was set on December 10, 2014. Final labeling rules published before January 1, 2015 would have a January 1, 2016 compliance date.

A compliance date has been set in order to give the food industry sufficient time to plan for using up existing labeling materials and to develop new, compliant ones. The FDA encourages the industry to comply with new labeling regulations as quickly as possible, so manufacturers do not have to wait until the compliance date to incorporate final regulations.

The FDA is currently considering comments for the proposed FDA Nutrition Facts and Supplement Facts labeling regulations that were released earlier this year, and will release final regulations at some point. The proposed regulations suggest format changes, changes in nutritional standards, and changes in standard portion sizes.
